Questions around the new Colorado Hand Weeding Limits posed by a farm owner who is a member of my organization: “For the rule… Beginning Jan 1, 2022, a worker may only hand weed or thin for up to 20% of their weekly time What does 20% of their weekly time mean? For example, if someone only works 15 hours a week, can they then only hand weed 3 hours a week? But if someone else works 60 hours a week they can hand weed 12 hours a week? That seems silly. We typically hire someone to come by and help weed for just only 15 – 20 hours a week. Is that no longer possible? What if someone prefers hand weeding to long handled hoe weeding (which has no time line restrictions, and I personally find more exhausting)? At the end of the day, we’re going to do what we need to do while also making the best decisions for our employees, including taking their opinions into full account. I’m just trying to fully understand these new laws and do the best that I can to follow them.”
